If Renault South Africa should fail to enforce any right or provision in these Terms and Conditions, you agree that this failure does not constitute a waiver of such right or provision or of any other rights or provisions in these Terms and Conditions. If a court should find that one or more rights or provisions set forth in these Terms and Conditions are invalid, you agree that the remainder of the Terms and Conditions shall be enforceable and that, to the extent permitted by law, the court shall give effect to the parties' intentions, as reflected in any such right or provision that has been declared invalid or unenforceable.
Renault Duster Promotional Competition Terms and Conditions:
The All-New Renault Duster – Stand a chance to win theUltimate Outdoor Adventure (the “Competition”).
This Competition is organised by Renault South Africa PtyLtd. (the “Promoter/s”).
2) Competition Period:
The Competition commences on 08h00 on Thursday 30 August2018 and will continue until 18h00 on Sunday 2 September 2018 (the “CompetitionPeriod").
3) Who May Enter:
3.1. To be eligible to enter, the entrant must:
3.1.1. reside in South Africa
3.1.2. be a natural person;and
3.1.3. be 18 years or older.
3.2. Participation in this Competition excludes employees,directors, members, partners, consultants and agents of, or any other personwho, directly or indirectly controls or is controlled by the Promoter/s ormarketing service providers of this Competition (and the spouses, lifepartners, immediate family members or business partners of the people orentities listed above) This means:
3.2.1. The Promoter/s;
3.2.2. supplier/s of goods and or services in terms of thisCompetition; and
3.2.3. promotional partners, printers, advertising andpromotional agencies, professional advisors and point-of-sale staff employed byor contracted to, or providing goods or services of any kind, to all the peopleor entities listed above during the Competition Period.
4) How to Enter:
4.1. During the Competition Period the entrants that meetall of the criteria referred to in clause 3 above must do the following inorder to stand a chance to win:
4.1.1. Visit the Photo Booth Activation at the RenaultStand (Pit lanes 20-22) at the SA Festival of Motoring, at the Kyalami GrandPrix Circuit between Thursday 30th August and Sunday 2ndSeptember;
4.1.2. input all the required fields onscreen at the PhotoBooth;
4.1.3. select a Renault Duster adventure of their choice;
4.1.4 have a phototaken at the Green Screen; and
4.1.5 share their photo on Social Media for additionalentries into the Competition
(including the following hashtags: #NewRenaultDuster RenaultGetCloser)
2. Once the qualifying entrant has fulfilled therequirements of clauses 3 and 4.1 above he or she will be automatically enteredinto the lucky draw.
4.3. The lucky draw shall take place on 7 September 2018 at14:00 at Dalmatian Advertising, Media Quarter, 5th Floor, cnrSomerset & De Smit Street, De Waterkant, Cape Town. The winner will bechosen in a random draw and the winner will be notified telephonically. Interms of sub-regulation 5 of section 11 of the Regulations to the CPA therewill be an independent accountant, registered auditor, attorney or advocate whooversees and certifies the conducting of the draw.
If we are not able to reach the winner within 24 hours ofthe draw taking place, i.e. if the winner does not reply to the message left ontheir cellphone notifying her/him of their win, another winner will be drawnafter said 24-hour period.
4.4. Entrants acknowledge and accept that the Promoter/sshall utilise a third party (the Promoters’ authorized agent/s) to contact theentrant, in the event that the entrant is a winner, and arrange fulfilment ofthe Prize. In order to effect the contacting and fulfilment process thePromoters shall provide the entrant’s information to such third party.
5) The Prize:
5.1. Entrants who fulfil the requirements stated in clause3 and 4.1 and 4.2 above stand a chance to win one of five Ultimate Adventureexperiences in Cape Town (“the Prize”). The experience will need to take placeduring the month of October/November 2018.
5.1.1. the lucky winner will be collected in a New RenaultDuster and transported to the location of their adventure experience;
5.1.2. at this location an indemnity form will need to besigned by the lucky winner prior to them being able to partake in the adventureactivity;
5.1.4. post the extreme experience taking place the luckywinner will be returned to the original collection point; and
5.1.5. should the lucky winner be in possession of a validSouth African driver’s licence they will have the opportunity to drive the NewRenault Duster as part of the adventure experience.
5.2. The winners’ prizes shall be fulfilled at a time andplace to be agreed upon between the Promoter/s and the winner. The winner willneed to supply acknowledgement of receipt of the prize.
5.3. The lucky winner will be filmed throughout theiradventure experience. Video and photographic content will be produced. Thiscontent will be used on Renault’s digital platforms for a period of 12 (twelve)months. The winner may decline to participate in such promotional activities.This decision must be in writing and will not affect the decision as to theoutcome of the competition.
6.1. The Promoter/s, its/their respective directors,affiliates, members, partners, employees, agents, consultants, suppliers, theircontractors, subsidiaries and sponsors assume no liability whatsoever for anydirect or indirect loss or damage, including but not limited to physical harmor death, howsoever arising from or as a result of an entrant’s participationin the Competition or the entrant’s redemption of any Prize in terms of thisCompetition, or from any amendments to Prize details and/or the terms andconditions of this Competition. All entrants (including the winner) herebyexpressly indemnify the Promoter/s in this regard and shall hold it harmlessfrom all and any claims arising from or as a result of the above reasons.
6.2. In so far as it is necessary, required by law orbeyond the reasonable control of the Promoter/s, the Promoter/s reserve/s theright to vary the nature of the Competition, the Prize, or these terms andconditions upon notice in this regard being published on www.renault.co.za orin another appropriate medium. In the event that the Prize is limited or variedin this manner, the Promoter/s shall replace the Prize with a prize of asimilar economic value.
6.3. With regard to clause 6.2 above, any amended terms andconditions published in any media will form part of the terms and conditions ofthe Competition, to which terms the entrants agree to be bound.
6.4. Each winner’s place of work shall be contacted on thecellphone number/via the medium used to enter the Competition or in terms ofany contact details supplied by the entrant when entering the Competition. ThePromoter/s shall attempt to contact the winner’s place of work for a period of24 hours after his or her name is drawn as a winner. In the event that thewinner is either uncontactable (during the time frames stipulated in thisclause 6.4) or in the event that the winner rejects or declines acceptance ofthe Prize, the Prize shall be subject to a new draw.
Prizes will be fulfilled during the month of October/November2018.
6.5. The Prize is not transferable and is not exchangeablefor another prize or cash and cannot be sold.
6.6. The decision of the Promoter in respect of disputesarising out of this Competition shall be dealt with by the Promoter in terms ofthese terms and conditions. The decision of the Promoter in this regard shallbe final.
6.7. There is (one) Prize to be won over the period of theCompetition.
6.8. The Promoter/s reserve/s the right to withhold thePrize until it is entirely satisfied that the claimant of the Prize is the bonafide winner, and reserves the right to call for such proof as it may deemnecessary.
6.9. The Promoter/s shall request that winners consent inwriting to their names, images and likenesses being used and published by thePromoter/s in connection with this Competition for a period of 12 (twelve)months after they are announced as winners. Winners may decline the use oftheir names, likenesses and images by the Promoter/s.
6.10. By entering this Competition entrants signify theirconsent to be bound by the terms and conditions contained herein. If a winneris under the age of 18 years (a “minor”) the winner will not be eligible forthe prize.
6.11. Winners agree that it is an express condition of theCompetition that, in order to be eligible to redeem the Prize, the winner shallbe required to sign the appropriate acknowledgement of receipt of the Prize, aswell as an indemnity and/or waiver of liability as reflected in these terms.
